12 फरवरी के संशोधित परिपत्र में आरबीआई दे सकता है 30 दिन की मोहलत

भारतीय रिजर्व बैंक (आरबीआई) ऋणदाता कंपनियों में शुरुआती संकट की पहचान के लिए भुगतान में एक दिन की चूक के विवादित निर्देश को बदल सकता है। इसके बजाया 30 दिन की मोहलत दी जा सकती है। यह अब निरस्त हो चुक 12 फरवरी के परिपत्र में किए जा रहे संशोधन का हिस्सा होगा। इससे भारतीय उद्योग जगत को राहत मिलेगी।

12 फरवरी के मूल परिपत्र के तहत मूलधन या ब्याज भुगतान या किसी भी अन्य राशि, पूर्ण या आंशिक रूप से एक दिन की चूक होने की स्थिति में बैंकों को संबंधित खाते को विशेष उल्लेख वाले खाते (एसएमए) के तौर पर वर्गीकृत करना होता था।

अब चूक के लिए ग्रेस पीरियड 30 दिन होगा एमएमए-0 चूक की श्रेणी के लिए आधार के रूप में हटा दिया जाएगा। एमएमए-0 के तहत चूक का मतलब है कि जब भुगतान 30 दिन से अधिक बकाया न हो लेकिन खाते में संकट के संकेत दिखते हों।

दूसरा बड़ा बदलाव यह होगा कि सावधि ऋण और कैश क्रडिट को बराबर माना जाएगा। कंेद्रीय बैंक के 12 फरवरी के परिपत्र को उच्चतम न्यायालय ने पिछले महीने निरस्त कर दिया था। इसके मुताबिक चूक के नियम सावधि ऋणों पर लागू थे, न कि कैश क्रेडिट सीमा पर। कैश के्रडिट के मामले में तभी चुक मानी जाती जब बकाया राशि लगातार 30 दिन से ज्यादा समय तक स्वीकृत सीमा से अधिक रहती है। संशोधित परिपत्र में सावधि ऋण के मामले में भी लगातर 30 दिन की अवधि को शामिल किया जाएगा।

Possible change in disputed instruction

Reserve Bank of India (RBI) can change the disputed instructions of one day’s defaults in payment for the identity of the initial crisis in lending companies. Instead 30 days can be delayed. It will now be a part of the revised amendment in the circular dated February 12.This will provide relief to Indian industry.

Under the original circular dated February 12, in case of principal or interest payment or any other amount, even in full or partial default of one day, the banks had to classify related account as special mentioning account (SMA).

Now the grace period for defaults will be 30 days and MMA-0 will be removed as the basis for the category of default. Missing under MMA-0 means that when the payment is not more than 30 days dues, but there are signs of crisis in the account. The second major change will be that term loan and cash credit will be considered equal.

The Circular of the Central Bank was canceled last month by the Supreme Court last month. According to this, the rules of default were applicable on fixed loans and not on the cash credit limit. In case of cash credit only if the outstanding amount is more than the allowed limit for more than 30 consecutive days. In case of fixed loan in the revised circular, the period of continuous 30 days will also be included.

New changes are also necessary as the minimum 40 per cent of the lender’s fund-based limit from April 1 is required as a fixed term loan component. From July 1, it has to be increased to 60 percent. This will affect the lenders, who themselves have to comply with the new system.

One source said that the issue was raised before the banking regulator that large companies, especially those dependent on the government’s payment, are in a position to keep a one-day default in debt payment. The case of companies of infrastructure sector is also the same as those who had to go under unsolicited pressure. There have been many such cases where banks have put the AAA rating firms in the category of defaulters. After payment by some companies, they were excluded from this category.

Under the IBC, changes can also be made in the prescribed timelines for the solution. This account will be deemed to have been classified as SMA-1. The reference date was March 1, 2018, as per the circular dated February 12 of the RBI. It was further stated, “If the reference date is deferred then within 180 days it will be sent to the IBC. And if the cases of defaults arise after the reference date, 180 days will be calculated from the date of first default in payment.
