It proposed to establish an independent authority in every state and UT for registration of tenancy agreements and even a separate court to take up tenancy related disputes.<\/p>\n<p>The government has claimed that the Model Tenancy Act will facilitate the unlocking of vacant houses for rental housing. \u201cIt is expected to give a fillip to private participation in rental housing as a business model for addressing the huge housing shortage,\u201d the Centre said in a press note.<\/p>\n<p>\u201cThe Cabinet approval for the Model Tenancy Act will provide the much-required boost to Rental Housing in India. It is a landmark reform that will usher in a new era for the real estate sector in the country,&#8221;. &#8220;The move will help address the high number of vacant residential units in India, which is over 11 million houses, making it economically productive, reducing litigation, and encouraging trust between the landlord and the tenants. The new model Tenancy act will also encourage and attract institutional investments into the residential assets,&#8221;.<\/p>\n<p><strong>Model Tenancy Act ticks the right boxes<\/strong><\/p>\n<p>The new law has several progressive provisions that can transform the rental-housing market. Its key features are:<\/p>\n<ul>\n<li>A tenant will give a maximum of two months&#8217; rent for residential property and a maximum of six months for commercial property as security deposit<\/li>\n<li>A written agreement between the landlord and tenant is mandatory<\/li>\n<li>The landlord cannot revise rent in between the rental period and three months&#8217; notice has to be given before the revision<\/li>\n<li>The landlord is responsible for fixing structural damages to the property and undertaking whitewashing, painting of walls, doors<\/li>\n<li>The tenant is responsible for repairs including kitchen fixtures, glass panels, maintenance of open spaces; must notify the landlord of any damage to the premises on an urgent basis<\/li>\n<li>The landlord cannot evict tenants during the contract period and stop providing essential services such as power and water<\/li>\n<li>The landlord is entitled to double the rent for two months and four times thereafter if the tenant occupies the property even after the termination of tenancy<\/li>\n<li>The tenant can sublet premises only with the prior consent of the landlord<\/li>\n<li>Appointment of a rent authority with the previous approval of the state or the union territory<\/li>\n<li>Setting up of rent courts by states to settle disputes within 60 days of receiving the complaint<\/li>\n<\/ul>\n<hr
