On the one hand, the Supreme Court has limited the powers of the GST Council, which was the new identity of power in the center-state relations, and has given the states the right to levy taxes. On the other hand, to save the political loss of inflation, the central states have to reduce VAT on petrol and diesel. <strong>The anti-climax is that the state governments are in the process of levying tax on their own on the basis of the new power from the court, because after June, the GST compensation to the state from the center will stop.<\/strong><\/p>\n<p>In 2017, when the states of India were agreeing on GST, leaving the right to levy tax, the question still existed that most of the states are consumers of industrial products and services, the number of producing states is limited, so how long lasting the unity between them will be. How long will Maharashtra and Bihar be able to do justice to the needs of their economies with this tax system? <strong>However, at the time of the introduction of GST, it was decided that as long as the central government keeps compensating the states for the loss due to GST, unity will remain. The loss compensation scheme will be closed from June, so cracks are sure to emerge.<\/strong><\/p>\n<p><strong>According to the Finance Commission, GST is causing an annual loss of about 4 lakh crores to the center and the state. In GST also, the effective tax rate is 11.4%, which is to be increased to 14%, which is a revenue neutral rate, that is, the governments will not suffer on this. That is why the GST Council is considering raising the tax rate on 143 essential products from 18 to 28%.<\/strong><\/p>\n<p>Between 1946 and 1950, there was a long debate in the Constituent Assembly on the rights of the Center versus the State. Balancing the insistence of the Constituent Assembly towards the Center, agreeing on a framework that gave power to the Center in times of crisis, but generally worked on the principle of federal (balanced rights to the states).<\/p>\n<p>The Finance Commission (1951), the first institution to be formed after the implementation of the constitution, makes equitable distribution of taxes and resources between the center and the state between economic disparity. In 2017, in the new avatar of India&#8217;s economic federalism, the states had delegated the right to levy taxes to the GST Council. The recession was taking a toll on this cooperative federalism. The Supreme Court has given new power to the states in the system of GST. If the Center does not show sympathized understanding, then the anti-climax of the Centre-State relationship can happen on the GST platform.<\/p>\n<hr \/>\n<p style=\"text-align: center;\"><span
