However, credit for GST paid while procuring goods and services for meeting CSR obligations is a grey area, with different advance ruling authorities giving contradictory orders.<\/span><\/p>\n<p><strong><span style=\"color: #000000;\">The authorities in Telengana and Uttar Pradesh have ruled in favour, while Gujarat and Kerala have ruled against it.<\/span><\/strong><br \/>\n<span style=\"color: #000000;\">The Telangana State Authority for Advance Ruling noted in its 20 October order that CSR spending mandated under the Companies Act is expenditure made for the furtherance of the business.<\/span><\/p>\n<p><span style=\"color: #000000;\">\u201cHence, the tax paid on purchases made to meet the obligations under corporate social responsibility will be eligible for an input tax credit under central GST and state GST Acts,\u201d said the order. The Authority for advance ruling in Uttar Pradesh explained in its January 2020 ruling that CSR spending is not voluntary but is a statutory obligation under company law, and hence tax credit on it is not restricted.<\/span><\/p>\n<p><span style=\"color: #000000;\">However, the Gujarat Authority for advance ruling, in its August 2021 order, explained that CSR activities are excluded from the normal course of business and, therefore, not edible for the input tax credit.<\/span><\/p>\n<p><span style=\"color: #000000;\">Experts said clarification on the matter should be in favour of the industry. \u201cBusinesses would expect a clarification on CSR in line with the favorable rulings on the issue and also keeping in mind that the term \u201dfurtherance of business\u201d mentioned in Section 16 of the CGST Act, should be interpreted in a manner beneficial to business and not in a restrictive manner.\u201d<\/span><\/p>\n<hr \/>\n<p><a href=\"https:\/\/plyinsight.com\/hi\/placement-wanted\/\"
