On 02 March 21, the state administration notified the Haryana State Employment of Local Candidates Act 2020, which requires all companies, LLPs, trusts, societies and partnership firms with more than 10 employees. To follow these local employment requirements and specifically empower the district administrations to enforce the new regulations through inspections with a 24-hour notice.

The move by the Haryana government requires that locals — born in the state or living there for five years — will be accounted for 75% of all hiring by companies in jobs with gross salary under Rs 50,000 per month.

Under the regulations, firms and companies would also have to register all of their employees receiving a gross salary of Rs 50,000 or less on a government portal and update it at regular intervals.

“This is like giving encouragement to inspector raj,” said JK Bihani, President HPMA. He flagged the provision in the law that requires a firm to seek exemption from the district administration if it cannot find enough qualified workers. This brings in an element of bureaucratic discretion in the entire process, he said.

“It is not possible for so many skilled and semi-skilled local workers to become available so quickly,” said Vikash Khanna, Secretary DNPMA noting that the government should be flexible in the implementation of this regulation so that businesses can continue their work “peacefully.”

The Andhra Pradesh assembly in 2019 passed a similar law, which has subsequently been challenged in courts.


हरियाणा में निजी नौकरियों में आरक्षण

हरियाणा में भाजपा की सहयोगी जजपा के चुनावी वादे निजी क्षेत्र की नौकरियों में हरियाणा के युवाओं को 75 फीसदी आरक्षण को राज्यपाल सत्यदेव नारायण आर्य ने 02 मार्च को मंजूरी दी थी। इसके तहत हरियाणा में जो भी नए उद्योग लगेंगे या पहले से स्थापित कंपनियां नई भर्तियां करेंगी, उनमें प्रदेश के युवाओं की 75 प्रतिशत नियुक्तियां अनिवार्य होंगी। कोई कंपनी, फैक्ट्री, संस्थान, ट्रस्ट अपने कर्मचारियों की जानकारी छुपाएगा तो उस पर जुर्माने का भी प्रावधान किया गया है।

50 हजार रुपये से नीचे की तनख्वा के सभी कर्मचारियों की जानकारी सरकारी वेबसाइट पर डालनी होगी। किसी फर्म अथवा रोजगार प्रदाता के अपने कर्मचारियों का पंजीकरण न करवाने, आधी-अधूरी अथवा झूठी जानकारी, फर्जी प्रमाण पत्र देने और नियमों का पालन न करने पर अलग-अलग धाराओं के तहत जुुर्माने का प्रावधान किया गया है।
