Suspension of BIS License (Reasons and Solutions)

The license granted by the Bureau of Indian Standards to any company can be put under suspension by the Bureau in the following situations.

Suspension of license is a situation in which the factory cannot put ISI mark on its goods and if the reply to the suspension is not given by the factory on time, then the Bureau has the right to cancel the license forever without giving any reason to the factory.

The information used in this article of mine is based on the information given in accordance with the Bureau of Indian Standards (Conformity Assessment) Act 2018; the reason for presenting it in simple language is only to make the readers aware about the Act 2018.

Request for suspension by licensee:-

(1) If the licensee finds it difficult to maintain the conformity of the product to the Indian Standard at any time, such as in the event of breakdown of any production machine or any testing equipment or due to natural calamities such as flood, fire, earthquake, lockout declared by the management, closure of operations as directed by a competent court or statutory authority, the licensee may suspend the use of his Standard Mark by informing the Bureau.

In such a situation, the suspension can be revoked by giving intimation to the Bureau as soon as the licensee has removed the deficiencies. After receiving the intimation from the licensee, the Bureau will make the license operative again, but it should be noted that this intimation will not remain effective for more than seven days from the date of validity of license and the license cannot be operative thereafter.

(2) If the licensee himself shifts his factory to a new premises, he may suspend the use of the Standard Mark by informing the Bureau. The Bureau may subsequently revoke the suspension only after verification by Bureau officials of the old premises and verification of the production process at the new premises.

Suspension by Bureau:-

(3) The Bureau may suspend the licence and direct the licensee not to use the Standard Mark on his product, if at any time it has sufficient evidence that the product bearing the Standard Mark does not conform to the relevant Indian Standard and such evidence shall not be limited to, but may include, one or more of the following, namely:

(I) Consecutive test reports indicating non-conformance of the product with the Indian Standard

(ii) Absence of Quality Control In-charge/Testing personnel despite the use of Standard Mark in the factory

(iii) Use of Standard Mark on non-conforming products

(iv) Major change noticed in the implementation of the plan of inspection and testing

(v) Major modification in the production process without prior assessment of the Bureau

(vi) Shifting of manufacturing unit to a new address without notice

(vii) Closure of manufacturing unit for a period exceeding six months without notice

(viii) Non-compliance of any direction issued by the Bureau from time to time

Process after suspension:-

1) The licensee whose licence is suspended shall stop using/affixing and dispatch of standard mark product from the factory and send a confirmation to the Bureau in this regard immediately and thereafter confirm the corrective action taken.

2) The Bureau may visit the factory to confirm the corrective action and after being satisfied that the licensee has taken the necessary corrective action and has produced sufficient evidence of conformity of the product to the relevant Indian Standard, may allow the suspension to be revoked.

3) If the licensee does not give a satisfactory reply to the suspension or does not pay the fee demanded by the Bureau in time, the Bureau may cancel the licence after issuing a notice of 21 days.
