Accused of Giving Misleading Product Info

Jalandhar: FICCI president and Hindustan Sanitaryware and Industries Limited (HSIL) managing director (MD) Sandip Somany and four other officials of the company have been summoned by a Jalandhar court on a criminal complaint filed by a Jalandhar-based distributor of firm. The distributor has alleged cheating by the company in its kitchen chimneys, sold under the brand name of Hindware. The chimneys have much less airflow than claimed by the company on the cover, catalogue and boxes of the product, it has been alleged.

The summons have been issued by the court of judicial magistrate first class (JMIC) Taranjeet Singh after recording the preliminary evidence and finding out that prima facie a case was made out against them under sections 420 and 120B of IPC. HSIL vice-president and MD Somany and others have been directed to appear before the court on April 8.

The court passed the order after going through the test reports of five models of the chimneys of the company given by a government-approved laboratory. The report showed that airflow in all the models was much less than the capacity stated on the labels of these prpducts.

Complaint Diljit Roy, proprietor of Royco Industries at Nakodar Road in Jalandhar; has filled the criminal complaint through his lawyer son Gautam Roy. He has told the court that he was distributor of Hindware for long and after 2012 he stated receiving complaints from customers and retailers. He has alleged that he had already purchased goods worth Rs 26 lakh.

In its order summoning the company officials, the court has held that accused in connivance with each other had supplied sub-standard chimneys by dishonestly concealing the material facts which would affect the transaction, by mentioning wrong description regarding air flow/air suction.

“Hence the accused have intentionally concealed the material facts regarding their product which amounts to deception..,” reads the court order, which was issued on February 6 and its copies were made provided to the complainant.

FINDINGS The court passed the order after going through the test report of five models of the chimneys of the company given by a govt – approved laboratory which showed that airflow in all models was much less than stated.

The court order has also mentioned that as per the bills placed on record, the disputed chimneys were purchased by the complaint in 2013 and that time Somany was the managing director of the company.

While going through the preliminary evidence, the court has held that the complainant had already paid compensation to a Jalandhar resident Manit Malhotra as ordered by Jalandhar consumer disputes Redressal forum on October 15, 2015, for supplying sun-standard product. The Forum had also ordered the company to pay compensation of Rs 15,000 to Malhotra, along with litigation expenses of Rs 3,000, and on December 9, 2016, the State Consumer Disputes Redressal Commission had also dismissed an appeal filed by HSIL.

Apart from Somany, HSIL area sales manager H S Negi, services head Vikas Gupta, quality head Vijendar Mittan and kitchen appliances head Alok Mishra have also been summoned.

हिंडवेयर चिमनी के एमडी सहित पांच को धोखाधड़ी के आरोप में समन जारी

चिमनी के नाम से किचन चिमनी को गलत एवं झूठे मापदंडो से बचे कर खुलेआम लूट मचाई जा रही है और सरकार मूक दर्शक बन कर चुपचाप तमाशा देख रही है।

यह है पूरा मामला

जालंधर में नकोदर रोड पर रायको इंडस्ट्री के मालिक गौतम राय जो कि हिन्डवेयर कंपनी के डिस्ट्रीब्यूटर हैं, वर्ष 2014 में सबसे पहले उनके पास एक ग्राहक शिकायत ले कर आया कि हिंडवेयर कंपनी की चिमनी जो पैसिफिक की थी।

ग्राहक के मुताबिक चिमनी का एयर फ्लो 820 क्यूबिक मीटर प्रति घंटा लिखा था लेकिन हकीकत में एयर फ्लो उससे बहुत कम है तो गौतम राॅय ने कंपनी के अधिकारियों से बात कि जिन्होंने विश्वास दिलाया कि उनका माल सही है किसी बात कि चिंता न करें। लेकिन उक्त ग्राहक संतुष्ट नहीं हुआ और उसने उपभोक्ता अदालत जालंधर में केस दायर कर दिया। अदालत ने उपभोक्ता के हक में फैसला सुनाते हुए चिमनी बदलने या पूरे पैसे 9100 रुपए ब्याज सहित वापिस करने के आदेश दिया। इसके बाद भी कंपनी पर कोई असर नहीं हुआ।

उसके बाद 2015 में ऐसी ही एक और शिकायत आई लेकिन कंपनी ने कोई भी बात सुनने से मना कर दिया। वह ग्राहक भी उपभोक्ता अदालत कि शरण में चला गया, तब उपभोक्ता अदालत ने दिल्ली कि एपैक्स टेस्टिंग एंड रिसर्च लेबोरेटरी से चिमनी का एयर फ्लो टेस्ट करवाया जिसने रिपोर्ट दी कि उक्त पेसिफिक माॅडल की चिमनी जिसका एयर फ्लो कंपनी द्वारा 820 क्यूबिक मीटर बताया गया है वास्तव में उसका एयर फ्लो 467 क्यूबिक मीटर है जबकि हिंडवेयर उपभोक्ता अदालत में एयर फ्लो सम्बंिधत कोई भी पुख्ता सुबूत पेश नहीं कर पायी।

उपभोक्ता अदालत ने लेबोरेटरी टेस्ट के आधार पर कि यह नदंिपत जतंकम चतंबजपबम है और चिमनी को बदलने या पैसे वापिस देने का आदेश दिया। जिसके बाद गौतम राॅय ने कंपनी के अधिकारियों सहित एम डी संदीप सोमानी के ध्यान में सारा मामला लाया लेकिन कोई सुनवाई नहीं हुई और उन्होंने अपना बकाया माल उठाने से भी मना कर दिया।

उसके बाद गौतम राॅय ने जालंधर पुलिस को कंपनी के खिलाफ धोखाधड़ी की शिकायत की लेकिन वहां भी कोई कारवाई नहीं हुई। उसके बाद सारा मामला उपभोक्ता मंत्रालय दिल्ली के ध्यान में सारा मामला लाया गया जहां से एक सर्कुलर किया गया की सभी राज्य सरकार इस पर कारवाई करें लेकिन कोई कारवाई नहीं की गयी। उसके बाद एडवरटाइसींग स्टैण्डर्ड काउंसल आॅफ़ इंडिया को शिकायत की गयी जिसने कंपनी की क्लीओ माॅडल एडवेरटाइसमेन्ट पर रोक लगा दी।

उसके बावजूद भी हिंडवेयर वही क्लीओ माॅडल अभी तक बेच रही है और कानून की धज्जियां उड़ा रही है। इन सभी दस्तावेजों एवं सुबूतों के आधार पर गौतम राॅय ने अपने वक़ील एडवोकेट नवजोत सिंह द्वारा की जालंधर की अदालत में प्च्ब् की धारा 156 (3) के तहत केस दायर कर दिया।

इस दौरान उपभोक्ता मामलों के विशेषज्ञ सुरिंदर मित्तल ने बताया की उक्त सारा मामला उपभोक्ताओं के अधिकारों के शोषण, धोखाधड़ी का है और सारा मामला भारत के प्रधान मंत्री नरेंद्र मोदी जी की कार्यालय को 16 अक्टूबर 2018 ध्यान में भी लाया गया है लेकिन अभी तक कोई भी सकारात्मक कारवाई नहीं की गई है। हिंडवेयर कंपनी चीन से माल मंगवा कर धोखे से अपना माल भारत के बाजार में बेच रही है लेकिन भारत सरकार इस पर न तो कोई रोक लगा रही है और न ही कोई कारवाई कर रही है। बहुत दुख की बात है कि एक तरफ तो चीन के बने माल का बहिष्कार करने की अपील कि जाती है और दूसरी पुख्ता सुबूत के बावजूद कोई कार्रवाई नहीं की जाती। भारत सरकार से अपील है कि तुरंत सारे मामले कि उच्च स्तरीय जांच कार्रवाई की जाये एवं इन सभी प्रकार की चिमनिओं की बिक्री पर प्रतिबन्ध लगाया जाये और कंपनी के खिलाफ धोखाधड़ी का मामला दर्ज किया जाए।
